The terms “I,” “we,” “us,” and “our” refers to Beautiful Dawn LLC. The terms “user,” “you,” and “your” refer to site visitors, customers, clients, and any other users of the site.
PAYMENTS AND REFUND POLICY
The payment method accepted by us is PayPal. You do not need to have a PayPal account in order to use this service. You may submit your payment by securely inputting your credit card information directly through the PayPal website.
To reserve your project start date with us, the Client shall pay to Beautiful Dawn LLC, the total project cost. You understand and agree that we will not book other projects during this time. In the event that you cancel the project for any reason, Beautiful Dawn LLC shall suffer losses that are difficult to ascertain. As such, if you cancel the project before work on the project begins, you will be refunded 50% of the total project cost. In the event that you cancel the project after work on the project has begun, the total project cost will be forfeited to Beautiful Dawn LLC.
We reserve the right to terminate an open project if we feel we cannot meet the client’s demands, or if a project has ceased to be profitable. If for some reason we do terminate a project, a refund will be issued in full.
In the event that a PayPal or other dispute is filed against Beautiful Dawn LLC, we reserve the right to revoke all Client rights to the deliverables discussed in the proposal and they will remain the property of Beautiful Dawn LLC until the dispute is resolved.
All custom blog designs are built on the Genesis framework. This framework is provided to you free of charge. If you want to receive support from StudioPress (the makers of Genesis), you must purchase your own copy of the Genesis framework.
All communication will be done via email. During the design process, it is important that I keep open projects on track and progressing at a reasonable speed. Failure to communicate in a timely manner (within 4 business days) may cause your project to be put on hold until my next available opening.
Additionally, if I have not heard from you for 15 consecutive days, your project will be considered abandoned and cancelled without notice. Work on your project will not continue and your payment will not be refunded. If there are any finished graphics, they will be provided to the client as flatted uneditable images.
If your project has been cancelled, and you request to resume your project some time in the future, it will be at my sole discretion and with a 20% (of initial project total) restart fee.
We work hard to complete all projects in a timely manner. The estimated time frame for projects is usually 3-7 weeks from start to install. How quickly we communicate and get through revisions will ultimately determine the exact time frame.
Work will be completed within our standard work week (Monday – Friday, 9 a.m. to 3:30p.m.). We are closed on all major holidays and the entire week of Christmas and New Years.
ILLUSTRATIONS AND STOCK IMAGE
I am not an illustrator, therefore custom illustrations are not available. If you would like to include any illustrations or stock images in your design, they must be purchased separately.
If you purchase a custom logo design, the logo files included are: EPS, PNG, JPG and PDF. If you need additional files, they will be provided. You will receive 3 concepts to choose from and 3 revision rounds for your chosen concept. You will receive full rights to the logo design.
When providing photos for integration into the design, we will only accept photos that meet the requirements of the project. For example, if a high resolution photo is required for the project, do not provide a small photo (low resolution) assuming we can just make it larger. This will lead to a sloppy, pixelated image which dramatically reduces the quality of your design.
Our designs meet the standards that comply with the latest versions of Mozilla Firefox, Google Chrome, Microsoft Edge, and Safari. We are not responsible for inconsistencies that may appear with older browser versions.
Your design is guaranteed to display properly in the most current versions of WordPress and Genesis (starting the date your design is installed). Your design is not guaranteed to be compatible with outdated, or future versions of WordPress or Genesis.
MOBILE RESPONSIVE DESIGN
Mobile responsive designs are tested on the most current versions of the Apple iPhone and iPad and Android operating systems. Mobile responsive designs are not guaranteed to display properly on outdated mobile devices.
Because we are paid per project, rather than hourly, it’s important that you communicate a clear vision for your project before placing your order. Any additional features, services, or revisions may be charged an additional fee.
Your blog design will be put together on a live demo site. After viewing the first draft of your design, you are allowed 3 revision rounds: one for major changes such as graphic re-designs and two for smaller edits such as color and font changes.
Sending multiple emails with one or two small changes at a time is not only time consuming and confusing, but it also goes against your included revisions. For this reason, we ask that you keep your revisions contained to one revision round per email.
After we’ve gone through your 3 revision rounds on the live demo site, additional major revisions are subject to a fee of $50 per revision. Additional minor revisions are subject to a fee of $12 per revision/tweak.
After we have completed the revisions on the live demo site, your design is considered complete. Revision rounds do not transfer over to post install support. Any revisions requested once the design is installed on your blog will be subject to a starting rate of $15 per revision.
Full payment must be made prior to the production of additional revisions.
Unless included with your project, you are responsible for creating, inputting, and arranging all content on your site. What this means is that I will not organize or write content for your posts or pages. Also, I will not create your navigation menu links, install plugins, add products to your shop, add images to your portfolio, or add widgets to your sidebar. I will only install custom content included with your project.
Additionally, if content entry is included with your project, I will not create the actual content for you. I will insert and style the text and images provided by you (the client) onto your blog.
If your project includes eCommerce integration, I will integrate, setup, and style the WooCommerce plugin. I will not add products to your shop. It is your responsibility to add products to your shop.
In order to install your design, I will need temporary access to your blog and possibly your hosting account. I will not share or sell this information. You are welcome to temporarily change your passwords while working with me.
I will give you a copy of all completed files and you should store them safely as we are not required to keep them. Additionally, I do not provide any native (editable) source files that I used in making your graphics.
Each blog design includes a specified number days for email support after your design is installed. Support means I will fix any errors with our coding and design only. I will also answer any questions you have about your new design. Any work requested after your support period has ended will be charged at a starting rate of $20 per request.
The client guarantees that any elements of text, graphics, photos, trademarks, or other artwork provided to us for inclusion in the project are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Beautiful Dawn LLC from any liability from any resulting claim or suit, arising from the use of such elements furnished by the client.
We retain the copyright to any and all work completed by Beautiful Dawn LLC. Rights to photos, graphics, source code, work-up files, and computer programs that were not created by us will not be not transferred to the client, and remain the property of their respective owners.
We retain the right to display your project as examples of our work in our portfolio. All blog design projects will contain a credit link to beautifuldawndesigns.net website at the bottom of your blog. This credit can be removed for an additional charge.
We can’t guarantee that the functions contained in any web page templates or in a completed website will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.
Additionally, we are not liable for any loss or damage to your blogs content while installing your new design, or any time after installation. We have never lost or damaged a clients website or content, but be aware that it can happen. It is your responsibility to backup your website before and after the installation process.
Our proposals do not include fees that may be incurred to have the project printed after final file delivery. We do not offer printing services, however, we recommend Vistaprint for your printing needs.
LETTER OF AGREEMENT
After your project has been booked, you will receive a letter of agreement to sign electronically. The letter of agreement must be signed by the client and Tiffany Griffin of Beautiful Dawn LLC before your project start date.
CHANGES TO THE TERMS OF SERVICE
We have the discretion to update our terms of service at any time. When we do, we will revise the updated date at the bottom of this page. If you have any questions about our terms of service, please contact us.
